Abstract

Konflik terjadi apabila satu pihak menghalang, menekan atau memaksa pihak lain menerima pendapatnya yang kemudiannya pihak ini terasa tergugat dengan tindakan pihak yang pertama. Meskipun konflik boleh diselesaikan oleh pihak-pihak berkonflik namun kerapkali ia memerlukan pihak
ketiga untuk menyelesaikannya. Pendekatan kualitatif kajian kes dipilih untuk menyempurna dan menjawab persoalan kajian iaitu memahami peranan Pegawai Sulh menyelesaikan konflik. Temuan kajian mendapati Pegawai Sulh menyelesaikan konflik dengan melaksanakan dua asas utama iaitu (a)tidak bertentangan dengan hukum syarak dan undang-undang dan (b) persetujuan bersama. Pegawai Sulh telah menjalankan dua peranan iaitu mediator dan kaunselor. Oleh itu mediasi-kaunseling sebagai satu konsep baru boleh diperkenalkan sebagai alternatif penyelesaian pertikaian untuk mnyelesaikan konflik.
