Abstract

Perubahan sosial dan perkembangan ekonomi sentiasa menghasilkan beberapa kontroversi di dalam bidang pendidikan. Apabila pentadbir pendidikan mengbadapi konflik, aspek undang-undang dan pihak mahkamah bertindak sebagai satu mekanisme menyelesaikan pertelingkahan tersebut. Perkembangan undang-undang pendidikan yang berbeza di kalangan negara tertentu juga menghadapi satu dilemma. Institusi pendidikan tinggi yang mempunyai hak istimewa, ingin mengekalkan alam sekeliling yang sesuai untuk menggalakkan kebebasan bersuara pelajar. Sebaliknya, pihak atasan berusaha mengawal tingkahlaku demikian melalui dasar serta prosedur tertentu bagi memastikan organisasi befungsi dengan berkesan. Walaubagaimanapun, perselisihan timbul apabila pelajar membantah mengatakan bahawa polisi dan prosedur demikian melanggar hak perlembagaan mereka.
